Terms of Service

These Terms of Service apply when you access or use Ask Max. By creating an account, submitting content, or continuing to use the platform, you agree to these terms and our Privacy Policy. If you do not agree, please do not use Ask Max.

1. About Ask Max

Ask Max is an Australian property review and transparency platform. It allows people to find properties and read or contribute resident reviews, ratings, street and suburb insights, and property photos. Content is provided for general information only and is not professional, legal, financial, building, pest, or real-estate advice.

2. Eligibility and accounts

You must be at least 18 years old and legally capable of entering into these terms. An account is required to submit a review, but some photo-submission features may be available without an account after email verification. You must provide accurate information, keep your login details secure, and promptly tell us if you believe your account has been compromised.

Ask Max may display a pseudonym rather than your real name. A pseudonym helps protect your public identity, but it does not make unlawful or abusive conduct acceptable.

3. Reviews, ratings, and area insights

When you submit a review or rating, you confirm that it reflects your genuine experience and honest opinion. You must not submit content on behalf of another person, accept payment or another benefit for it without clear disclosure, manipulate ratings, or misrepresent your connection to a property.

Property ratings may also contribute to aggregated street and suburb insights. We may summarise, group, or calculate statistics from submitted content, but those insights may be incomplete and should be considered alongside other sources.

4. Photos and other uploads

You may only upload content you own or are authorised to share. Photos must accurately represent the property and must not be deceptively edited, staged to mislead, or used to target an individual. Before uploading, remove or obscure people, children, vehicle number plates, mail, identity documents, access codes, keys, computer screens, family photographs, and other private or identifying information.

Do not upload material taken in a place where photography was prohibited or in a way that breaches another person's privacy, confidentiality, tenancy obligations, or other legal rights.

5. Verification material

We may request information or documents to verify your connection to a property or the authenticity of a contribution. Verification material is not published and is handled as described in our Privacy Policy. You may cover information that is not needed for verification. Do not upload identity documents unless we specifically request them.

6. Prohibited conduct and content

You must not use Ask Max to submit or distribute content that:

  • you know is false or misleading, or that is not based on a genuine experience;
  • is defamatory, threatening, harassing, discriminatory, obscene, or unlawfully invasive of privacy;
  • identifies or targets a private individual unnecessarily, including a tenant, neighbour, owner, agent, or tradesperson;
  • infringes copyright, trade marks, confidentiality, or another person's rights;
  • contains advertising, spam, malicious code, or attempts to manipulate the platform; or
  • otherwise breaks the law or encourages unsafe or unlawful conduct.

7. Moderation and publication

Submissions may be checked by automated systems and/or people before or after publication. We may publish, delay, reject, label, restrict, edit for privacy or formatting, return to pending, or remove content where reasonably necessary to operate the platform, enforce these terms, address a complaint, or comply with law. A verification or trust indicator is not a guarantee that every statement is correct.

We may suspend or close accounts involved in serious or repeated breaches. Where appropriate, we may preserve relevant records while a complaint, dispute, safety issue, or legal obligation is being handled.

8. Complaints, corrections, and takedowns

If you believe content is inaccurate, unlawful, unsafe, privacy-invasive, or infringes your rights, contact us at legal@askmaxproperty.com.au and include the page URL, the content concerned, your reasons, and supporting information. We may temporarily restrict content while reviewing a complaint. We may contact the contributor for a response but will not disclose their personal information unless authorised or legally required.

9. Licence to submitted content

You retain ownership of content you submit. You grant Ask Max a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, format, moderate, publish, communicate, and display that content for operating, improving, promoting, and protecting the platform. This licence continues for content already shared or reasonably retained for legal, integrity, backup, or dispute-resolution purposes, even if you close your account.

10. Platform and third-party services

Ask Max relies on third-party services for hosting, authentication, maps, address search, security checks, email delivery, and related functions. Their availability and terms may affect parts of the platform. Links, maps, street imagery, property details, and third-party data are provided for convenience and may be incomplete, delayed, or inaccurate.

11. Disclaimers and liability

User content represents contributors' experiences and opinions, not Ask Max's views. To the extent permitted by law, we do not guarantee that the platform will always be available, secure, complete, or error-free, or that any review, rating, photo, address, map, or insight is accurate or current. You remain responsible for your own enquiries and decisions.

Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot lawfully be excluded, including under the Australian Consumer Law. Subject to those non-excludable rights, Ask Max is not liable for indirect or consequential loss arising from use of, or reliance on, the platform.

12. Changes and ending access

We may change the platform or these terms. If a change is material, we will take reasonable steps to notify users, such as by posting a notice or emailing registered users. The updated date above shows when these terms last changed. You may stop using Ask Max at any time.

13. Governing law

These terms are governed by the laws of Australia and the applicable laws of the state or territory in which Ask Max operates. Nothing in this section prevents you from exercising rights available under applicable consumer law.
